By accessing or using Klone (“we,” “our,” or “us”) and its associated services (the “Services”), you agree to be bound by these Terms of Service. If you do not agree with these terms, you may not use the Services.
2. Description of Services
Klone provides a software platform for managing customer relationships, automating business workflows, tracking communications, and integrating with third-party tools. Certain features may require a paid subscription.
3. Account Registration and Security
To access the Services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for any activities that occur under your account.
4. Subscription and Payment
Klone offers both free trial and paid subscription plans. Fees are billed on a recurring basis according to your selected plan. You authorize us to charge your chosen payment method and agree to keep your billing information up to date. All payments are non-refundable, except where required by law.
5. Acceptable Use Policy
You agree not to misuse the Services or help anyone else do so. This includes but is not limited to:
- Violating any laws or regulations
- Infringing on the rights of others
- Attempting to gain unauthorized access to the Services
- Disrupting or degrading the performance of the Services
6. Data Privacy and Security
Your privacy is important to us. By using the Services, you consent to the collection and use of your data as described in our Privacy Policy. We implement appropriate security measures, but you acknowledge that no system is completely secure.
7. Intellectual Property
All rights, title, and interest in and to the Services, including all related intellectual property, are and will remain the exclusive property of Klone or its licensors. You may not reproduce, modify, or distribute any part of the Services without our express written consent.
8. Termination
We may suspend or terminate your access to the Services at any time for violations of these Terms or if we believe your use may cause harm to other users, our business, or third parties. You may cancel your subscription at any time from your account settings.
9. Disclaimers
The Services are provided “as is” without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be error-free or uninterrupted.
10. Limitation of Liability
To the fullest extent permitted by law, Klone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
11. Changes to Terms
We reserve the right to update or modify these Terms at anytime. If we make material changes, we will notify you by email or through the platform. Your continued use of the Services after the changes take effect constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of laws rules. Any legal action must be brought in the courts located within St. Tammany Parish.
